Possession of Drug Paraphernalia

Under Florida Statute Section 893.147(1), a person cannot use or possess with the intent to use drug paraphernalia. In Florida, usually, drug paraphernalia is an item that is used to ingest or inhale a controlled substance, such as marijuana or cocaine. However, it can be an item that helps a person prepare, cultivate, or store a controlled substance. Possession of Drug Paraphernalia is a first degree misdemeanor, which is punishable by 12 months in the county jail and a $1,000 fine.
